How many states have a rule that allows for the use of the complaint precess for due process hearing decisions? Also, there is a lot of complaining here that mediation is not effective because the agreements are not enforced and are breached.  I have been wondering whether enforcing through the complaint process under a state rule would be an improvement for parents – the ability to enforce in court is a much harder burden, process for parents. Thoughts about this would be appreciated.

How do states handle school districts who do not comply with a corrective action plan issued in a state complaint?

Do any states attempt to enforce shorter timelines than the regulatory 1 year for corrective actions? If so, what/how do you enforce?

What do other states do in regards to the signature and acceptance?

Does any other state have something akin to what we call “educational collaboratives” (basically, two or more school committees of cities, towns, and regional school districts enter into an agreement to form a collaborative for the purpose of providing special education services to resident students)? We have been presented at hearing with an interesting question regarding the doctrine of  stay-put vis a vis a collaborative placement, and are seeking input from others who may have dealt with this issue.

What are other states doing in regard to early resolution of special education dispute?

Besides mediation, does your state have any other options that the parties may access to resolve the complaint?

If parents are divorced, but share legal decision making authority equally do you notify the non-filing parent and provide a copy of the IR?  Or consider it a domestic matter that they will communicate about between them?

I am checking to see how different states are approaching the FAPE analysis and corrective action piece as it relates to services provided or not provided during the 2019/20 distance learning period due to the COVID-19 pandemic.
