Is your state one or two tier? What do you see as pros and cons for each, to the extent that you have had experience with both? Has any state gone from a 2-tier to 1-tier, and then back again? Any other considerations that we should think about?
What technology is being used in due process systems in other states? Do you have specific systems or security requirements for: Initial filings; Subsequent filings (motions, briefs, exhibits, etc.); and/or Routine communications (scheduling, etc.)? We had several mediations that were held during the FY 2017-2018 reporting period related to due process complaints filed during the FY 2016-2017 reporting period, all of which resulted in mediation agreements. Any idea how I report this with without making my due process hearing data look wrong?
We are considering changes to our state special education rules to address extensions/continuances in IDEA due process hearings. We have several due process complaints that have been “open” for years because the parties continue to request extensions, and our current rules do not provide our Administrative Law Judges with clear authority to deny these requests. Do you have rules that limit the length/number of extensions in due process hearings? If not, do you find any support in IDEA regulations that would allow the hearing officer to deny repeated requests from parties for extensions?

Specifically, how are the Due Process responsibilities in other states (of similar population) organized and distributed among support and professional staff? There is a pending due process complaint that was initiated by a school district several months ago and it is about to go to hearing. Then, a couple days ago, the parent initiates a due process complaint against the district. The parent initiated complaint alleges that it is based on many of the same facts as the pending action and they would not object to the two being combined.
We are getting questions about resolution sessions. They are worried about parent attorneys who do not agree to mediation or to waive it. Has anyone discussed this issue in their state? (Posted March 2020)
