We are considering changes to our state special education rules to address extensions/continuances in IDEA due process hearings. We have several due process complaints that have been “open” for years because the parties continue to request extensions, and our current rules do not provide our Administrative Law Judges with clear authority to deny these requests. Do you have rules that limit the length/number of extensions in due process hearings? If not, do you find any support in IDEA regulations that would allow the hearing officer to deny repeated requests from parties for extensions?
