I am curious about how many 1 tier states are paying for due process hearing officer costs out of the SED Part B funds.  Also, I am wondering whether any 1 tier states are not paying for hearing officer costs out of SEA Part B funds but allowing LEAs to use Part B funds to pay for hearing officer costs.   This is a slight twist on the June 2020 OSEP letter attached. Also, are any tier 1 states not using its own or allowing LEAs to use their Part B funds to pay for hearing officer costs and requiring LEAs to use state funds?
