How does the timing play out in this situation: A student is involved in a fight and the school district issues a 10 day suspension whereby the student is out of school the next day and for the following 10 days.  The district schedules a manifestation review for a week later but has to reschedule.  The manifestation review is held 10 days after the incident.  The conduct is found to be a manifestation of the student’s disability but the student has already served the 10 day suspension.  Violation?  I am struggling with how to reconcile the regulation “Within 10 school days of any decision to change the placement of  child with a disability because of a violation of a code of student conduct, the LEA”  must conduct the manifestation review with the section that says if the behavior is found to be a manifestation, the district must return the student to his placement.
